1.
Order
1.1.
The Customer orders the Artists’s Work in any form of written communication, including email, letter, or online communication (e.g. WhatsApp, Facebook Messenger, or similar) that allows for clear identification of the Customer. Regardless of the method of communication used when ordering the Artists’s Work, the confirmed order becomes binding.
1.2.
The order represents a demand by the Customer to purchase the Artists’s Work in accordance with these Terms and Conditions. The Customer is responsible for ensuring that the order conditions and any relevant custom specifications (dimensions, material, color) communicated to the Artist are complete and accurate.
1.3.
An order is only considered accepted when the Artist issues a written acceptance of the Order (in the form of the supplier’s order confirmation form) and the Customer pays the advance invoice issued by the Arist in the amount of 60% of the price of the work.
1.4.
All samples, drawings, descriptions, sketches, or visualizations created by the Artist and any visualizations contained in the Artist’s catalogs or brochures are provided solely to give an approximate idea of the Artist’s Work referred to therein.
2.
Artist's Work
2.1.
The Artist’s Work is described on the Artist’s website www.jirikrejcirik.com, including any custom modifications requested by the Customer.
2.2.
The Artist reserves the right to adjust any custom specifications from the Customer if they are not in compliance with legal or regulatory requirements if required by regulations. In this case, the Artist is obliged to inform the Customer of this fact.
3.
Delivery
3.1.
After completion of the work, the Artist shall notify the Customer of this fact. The Artist will send detailed photographs of the work and request the remaining payment.
3.2.
Delivery can be arranged by the Customer independently or by using the Artist’s services.
If the Customer arranges transportation independently, the item must be picked up at the specified address after 100% of the price has been paid.
3.3.
If transportation is arranged by the Artist, the ordered Artist’s Work will be delivered to the Customer in appropriate packaging to prevent damage during transportation.
For international deliveries, the Customer must define requirements for any necessary packaging certifications at the time of order. These certifications are not included in the transport cost.
3.4.
The Artist will ensure that each shipment includes a shipping label with the delivery address and the final invoice. The invoice must include the price of the work, order date, all relevant reference numbers of the Customer and Artist. The packing list must include a description of the type and quantity of the Artist's Work and any special delivery instructions (if any).
3.5.
The Artist will deliver the Artist's Work via a shipping company to the address stated in the Order or another location agreed by both parties (“Place of Delivery”) at any time after notifying the Customer that the work is ready for shipment. The Customer is responsible for related import duties and applicable taxes, which are not included in the price of the Artist's Work.
3.6.
Delivery is deemed complete upon unloading of the Artist's Work at the Place of Delivery.
3.7.
Any dates and/or delivery times stated in the sales order form are approximate and indicative only and depend on the availability of the Artist's Work and production schedules.
4.
Price and Payment
4.1.
Unless otherwise agreed in writing between the Customer and the Artist, all orders are subject to full advance payment.
4.2.
A 60% advance will be invoiced based on the price of the Artist's Work stated in the confirmed order. The remaining 40% shall be paid by the Customer prior to shipping or pickup of the work based on the Artist's tax invoice
4.3.
The price of the Artist's Work does not include value-added tax (VAT), which the Customer is additionally required to pay at the applicable rate, provided a valid VAT invoice is issued. The price also excludes transportation costs, import duties, fees for any applicable import documents (including for the EU), and relevant taxes, which will be invoiced to the Customer.
4.4.
The Artist reserves the right to update the price list periodically.
4.5.
A payment is considered made when the full amount payable is credited to the Artist's bank account. The Customer shall make the payment based on written instructions from the Artist to the bank account designated by the Artist.
5.
Claims and Warranty
5.1.
The Artist shall inspect the Artist's Work prior to dispatch to ensure it is free of defects.
5.2.
The Customer is obliged to carefully inspect the Artist's Work immediately upon receipt for any obvious quality defects or discrepancies with the order (quantity defects).
5.3.
Any claims regarding such defects must be submitted to the Artist no later than 14 days after delivery. Claims submitted after 14 days may be rejected by the Artist.
5.4.
This warranty does not apply to minor deviations from the agreed specifications.
5.5.
The warranty also does not apply to work that, in the Artist's opinion, has been subject to ordinary wear and tear, improper handling, incorrect installation or maintenance, modifications, repair attempts, neglect, misuse, or accident.
5.6.
Claims must be made in writing (by email or letter) and supported by a detailed description and relevant documentation, including photos or video if applicable.
If defects are claimed, the Customer must provide the defective item upon the Artist's request, packaged properly to prevent further damage.
5.7.
The Artist assumes no further guarantees or obligations unless explicitly stated in the order.
5.8.
Artist's Work - Light Objects and Luminaires
5.8.1.
The products are designed and manufactured in compliance with national and European directives and made from certified electrical components.
5.8.2.
The fixtures are, as standard, supplied without control gear and power supplies. – therefore, they do not constitute a complete electrical device.
5.8.3.
It is forbidden to use the product for any purpose other than its intended use and in contradiction with the Author’s recommendations, for safety reasons and because such use voids the warranty. The luminaire is an electrical device; therefore, all assembly, maintenance, and cleaning operations must always be performed with the luminaire switched off. Any intervention in the electrical installation of the luminaire, including its connection, may only be carried out by a qualified electrician.
Children and persons with reduced sensory or mental abilities must be prevented from handling the luminaire and its components, as the product contains small and fragile parts that could pose a hazard if mishandled or swallowed. During operation, LED chips become significantly heated – the luminaire must not be covered, and no flammable objects may be placed within a distance of 1 meter from it. Failure to maintain this minimum distance may result in a fire hazard and/or damage to the luminaire.
5.8.4.
Installation:
When assembling and installing the luminaire, the following procedures must be observed:
After unpacking, first check that the luminaire has not been damaged during transport and that it is complete.
In the event that damage has occurred during transport, it is necessary to take photographs of the damaged packaging and of the damage to the product both inside the transport box and after it has been removed from the packaging.
Then contact the author of the work immediately, as later claims for damage of this nature cannot be accepted.
The luminaire must not be put into operation if its electrical components are damaged.
Assembly of the luminaire must be carried out in such a way that all electrical wiring and connection to the mains are performed exclusively by a qualified electrician. The electrical installation must comply with the requirements and regulations of the country of use. Check that the data on the nameplate or in the installation manual corresponds to the voltage of the electrical network. Do not attempt to operate the luminaire at a different voltage.
When selecting mounting hardware, always consider the construction of the ceiling to which the luminaire is attached and the applicable technical standards. If necessary, an alternative method of mounting (e.g., chemical anchors, etc.) appropriate to the situation and the weight of the luminaire may be used.
The Author assumes no responsibility for defects resulting from improper or negligent handling, whether during installation, maintenance, or subsequent repairs. If the installation or any other intervention has been carried out by an uncertified specialist, no subsequent warranty claim may be made to the Author.
5.8.5.
Surface Cleaning:
Clean only with a dry, soft microfiber cloth, while wearing gloves.
Failure to use the prescribed cleaning materials may cause damage to the surface of the luminaire.
Do not use abrasive or chemical cleaning agents.
Always clean the luminaire when it is switched off, and allow it to cool down completely before cleaning.
5.9.
Artist's Work - Furniture and Objects
5.9.1.
After unpacking, first check that the product has not been damaged during transport and that the packaging is complete. In the event that damage has occurred during transport, it is necessary to take photographs of the damaged packaging and of the damage to the product both inside the transport box and after it has been removed from the packaging. Then contact the author of the work immediately, as later claims for damage of this nature cannot be accepted.
When assembling and maintaining the furniture, the author’s recommendations must be observed. The author reserves the right to provide an assembly manual for the work. The furniture must not be cleaned with abrasive or chemical cleaning agents. It may only be wiped with a dry or slightly damp cloth or nano sponge, using clean water or a mild soap solution.
The author assumes no responsibility for defects caused by improper or negligent handling. This applies both to the assembly of the work after delivery and to its subsequent maintenance and any repairs.
6.
Liability and Damages
6.1.
The Artist's liability is limited to direct damage to the work itself and, unless agreed in writing otherwise, in no case exceeds the amount paid by the Customer for the respective work.
